GOAL?
As we begin to fight back in Ohio, it's critical that all our efforts - legal, policy, political, educational, advocacy, and mobilization - utilize a common language in discussing and advocating our rights in Ohio under the Ohio Constitution.
WHAT?
Approximately 1 ½ hour presentation on the Ohio Constitution, the Ohio Bill of Rights, and the Ohio constitutional language and decisions that will define the immediate fight in Ohio. The seminar is an introduction to the Ohio Constitution and Ohio Bill of Rights. It is intended for general audiences.
TOPIC?
In the Dobbs decision overturning Roe and Casey, Justice Alito claimed that “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”
In the immediate future, much of the battle over reproductive rights and choice will be fought at the state level - in the Ohio Legislature and the Supreme Court of Ohio (and perhaps at all levels of Ohio county and local government).
This brings an often-overlooked document to the fore - the Ohio Constitution and its Bill of Rights.
As declared by the Ohio Supreme Court, “the Ohio Constitution is a document of independent force.”
In contrast to the US Constitution Bill of Right’s focus on limitation of government powers, the Ohio Constitution Bill of Rights (Article I) enumerates AFFIRMATIVE RIGHTS inherent or expressly reserved to the people.
The citizens of Ohio (and the Ohio Supreme Court) have the freedom to utilize the Ohio Consitution’s fundamental power to define more broadly our inalienable personal rights - including reproductive rights and choice - under the Ohio Bill of Rights than the Dobbs Supreme Court has now rejected and revoked as federal rights under the US Constitution.
The US Constitution and the decisions of the US Supreme Court are the FLOOR of our rights. As Ohioans, we can reclaim the right to personal independence, autonomy, privacy, and CHOICE through OUR OHIO CONSTITUTION.
